The Federal Circuit:  30 Years Back, 30 Years Forward

On April 2, 1982, President Reagan signed the Federal Courts Improvement Act of 1982, which created the new United States Court of Appeals for the Federal Circuit.  Since its inception, the Federal Circuit has delivered a panoply of decisions that have had far-reaching implications on a host of intellectual property, international trade, government contracts, and veterans benefits issues. 

In conjunction with its annual review of the Federal Circuit’s decisions, the American University Law Review is hosting a symposium commemorating the thirtieth anniversary of the court.  In doing so, each panel will engage in a retrospective look at the Federal Circuit’s body of jurisprudence, discerning trends and highlighting key cases that will be essential for practitioners appearing before the court in the years to come.  The event will also focus on the future of the court, asking questions such as:  what’s next after the Leahy-Smith Act?  What are the implications of the court’s continuing saga of spent nuclear fuel cases?  Will Commerce determine a method to apply CVD laws to non-market economies without realizing the CIT’s fears of double-counting?  How will the court reconcile Gardner’s presumption against the backdrop of Chevron deference?
